Welcome to By God. These Terms of Service ("Terms") govern your access to and use of the By God mobile application (the "App"), provided by Katarzyna Radan ("we," "us," or "our").

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. About By God

By God is a spiritual wellness application that provides daily inspirational content, personalized verses from various religious traditions, AI-powered conversational guidance, and tools for personal reflection and spiritual growth. The App is designed to support users across multiple faiths and spiritual backgrounds.

2. Eligibility

2.1 Age Requirement
You must be at least 13 years of age to use the App. If you are under 18, you must have permission from a parent or legal guardian to use the App.

2.2 Account Creation
To access certain features, you must create an account using Google Sign-In or other supported authentication methods. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

3. IMPORTANT DISCLAIMERS

3.1 Not Professional Advice
THE APP AND ALL CONTENT, INCLUDING AI-GENERATED RESPONSES, ARE PROVIDED FOR INFORMATIONAL AND INSPIRATIONAL PURPOSES ONLY. THE APP DOES NOT PROVIDE MEDICAL, MENTAL HEALTH, THERAPEUTIC, COUNSELING, LEGAL, FINANCIAL, OR ANY OTHER PROFESSIONAL ADVICE.

3.2 No Substitute for Professional Services
The AI chat feature and all content within the App are not a substitute for professional counseling, therapy, medical care, or other professional services. If you are experiencing a mental health crisis, medical emergency, or need professional support, please contact qualified professionals or emergency services immediately.

3.3 AI Limitations and Accuracy
The AI-powered chat feature uses artificial intelligence technology that:

• May produce inaccurate, incomplete, or inappropriate responses
• May not understand context or nuance in all situations
• Should not be relied upon for critical decisions
• Does not replace human judgment, professional advice, or religious guidance from qualified clergy or spiritual leaders

3.4 Religious and Spiritual Content

• The App provides content from multiple religious traditions and spiritual perspectives
• We strive for accuracy and respect but cannot guarantee the theological correctness or appropriateness of all content for your specific beliefs
• The inclusion of content from various religions does not constitute endorsement of any particular faith or interpretation
• You should consult with appropriate religious leaders or scholars for authoritative guidance on religious matters

3.5 User Responsibility
You are solely responsible for:

• Your interactions with the AI chat feature
• How you interpret and apply any content or guidance from the App
• Your spiritual and religious practices
• Evaluating the suitability of content for your personal beliefs and circumstances

4. Subscriptions and Payments

4.1 Subscription Plans
The App offers the following subscription options:

• Weekly Subscription: $5.99/week
• Annual Subscription: $49.99/year
• Annual Non-Refundable Subscription: $29.99/year (special promotional rate, no refunds)

4.2 Free Trial
New subscribers may be eligible for a free trial period of 3 or 7 days (as specified at sign-up). You will be charged when the trial period ends unless you cancel before the trial expires.

4.3 Billing

• All payments are processed through Apple's In-App Purchase system
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your Apple account will be charged upon confirmation of purchase
• Subscriptions automatically renew at the same price unless pricing changes are communicated in advance

4.4 Cancellation
You may cancel your subscription at any time through your Apple account settings. Cancellation takes effect at the end of the current billing period.

4.5 Refund Policy

• Refunds are generally not available except as required by law
• Special Exception: If you have not used the AI chat feature during your subscription period, you may request a refund by contacting [email protected] within 7 days of purchase
• Non-Refundable Subscription: The $29.99/year promotional subscription is strictly non-refundable under all circumstances
• All refund requests are subject to review and approval
• Refunds for purchases made through Apple In-App Purchase are subject to Apple's refund policies

4.6 Price Changes
We may change subscription prices at any time. Changes will not affect your current subscription period but will apply upon renewal. You will be notified of price changes in advance.

5. User Conduct and Responsibilities

5.1 Acceptable Use
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App in any way that violates any applicable local, national, or international law or regulation
• Transmit or submit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Attempt to gain unauthorized access to any part of the App or related systems
• Use any automated means (bots, scrapers, etc.) to access the App
• Reverse engineer, decompile, or disassemble any part of the App
• Interfere with or disrupt the App or servers/networks connected to the App
• Impersonate any person or entity or misrepresent your affiliation
• Use the App to harm, threaten, or harass others
• Share content that infringes on intellectual property rights
• Attempt to manipulate, abuse, or exploit the AI chat feature

5.2 Content Responsibility
You are solely responsible for:

• All content you submit through the App (reflections, chat messages, etc.)
• Ensuring your content does not violate these Terms or any applicable laws
• The consequences of sharing your content

5.3 No Content Moderation
We do not actively monitor or moderate user-generated content (such as your personal reflections or chat interactions). You use the App at your own risk and are responsible for your own exchanges and interactions with the AI.

6. Intellectual Property Rights

6.1 Ownership
The App, including all content, features, functionality, software, text, images, and graphics, is owned by Katarzyna Radan and is protected by international copyright, trademark, and other intellectual property laws.

6.2 License to Use
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and use the App on your personal device(s)
• Access and use the content for your personal, non-commercial use

6.3 Restrictions
You may not:

• Copy, modify, distribute, sell, or lease any part of the App
• Extract or attempt to extract the source code
• Create derivative works based on the App
• Remove any copyright or proprietary notices

6.4 Religious Text Sources
The App includes verses and texts from various religious scriptures and traditions. While we hold rights to our compilation and presentation of this content, the underlying religious texts are in the public domain or used under appropriate licenses.

7. Privacy and Data Collection

Your privacy is important to us. Please review our Privacy Policy (available at [PRIVACY POLICY URL]) to understand how we collect, use, and protect your personal information.

By using the App, you consent to our collection and use of your data as described in the Privacy Policy.

8. Account Termination

8.1 Termination by You
You may delete your account at any time through the App settings. Upon deletion, your data will be retained for 30 days before permanent deletion, unless your account has been banned (see below).

8.2 Termination by Us
We reserve the right to suspend or terminate your account and access to the App at any time, without notice, for any reason, including but not limited to:

• Violation of these Terms
• Illegal activity or suspected fraud
• Abusive behavior or harassment
• Misuse or exploitation of App features
• Risk to the security or integrity of the App
• Extended inactivity

8.3 Banned Accounts
If your account is terminated for violation of these Terms or illegal activity, your data may be retained for up to 2 years for legal, safety, and security purposes.

8.4 Effect of Termination
Upon termination:

• Your right to use the App immediately ceases
• We are not obligated to provide refunds for any unused subscription time
• Certain provisions of these Terms (including disclaimers, limitations of liability, and indemnification) will survive termination

9. Third-Party Services

9.1 Integration with Third Parties
The App integrates with third-party services including:

• Google Sign-In (for authentication)
• Apple In-App Purchases (for subscriptions)
• Supabase (data storage and backend services)
• OpenAI and Google AI (for AI chat functionality)
• Sentry (for error monitoring)

9.2 Third-Party Terms
Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or policies of third-party services.

9.3 No Endorsement
The inclusion of links or integration with third-party services does not imply endorsement or affiliation.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

10.1 THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

10.2 WE DO NOT WARRANT THAT:

• The App will be uninterrupted, secure, or error-free
• Any defects will be corrected
• The App is free of viruses or harmful components
• The results obtained from using the App will be accurate, reliable, or meet your requirements
• Any AI-generated content will be accurate, appropriate, or helpful

10.3 IN NO EVENT SHALL KATARZYNA RADAN, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or use
• Personal injury or emotional distress
• Decisions made based on App content or AI responses
• Spiritual, religious, or theological disputes or consequences
• Any damages resulting from your reliance on App content

10.4 OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR $100 USD, WHICHEVER IS GREATER.

10.5 SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

11. Indemnification

You agree to indemnify, defend, and hold harmless Katarzyna Radan, and our affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your content or conduct while using the App
• Any decisions you make based on App content or AI responses

12. Dispute Resolution and Governing Law

12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions.

12.2 Jurisdiction
You agree that any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

12.3 Informal Resolution
Before filing any formal claim, you agree to contact us at [email protected] to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith.

12.4 No Class Actions
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

13. Changes to These Terms

13.1 Right to Modify
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms within the App or on our website.

13.2 Notification
We will notify you of material changes by:

• Posting a notice within the App
• Updating the "Last Updated" date at the top of these Terms
• Sending an email to your registered email address (if applicable)

13.3 Continued Use
Your continued use of the App after changes to these Terms constitutes your acceptance of the revised Terms.

14. General Provisions

14.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Katarzyna Radan regarding the App and supersede all prior agreements.

14.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

14.3 Waiver
Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

14.4 Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.

14.5 No Agency
Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and us.

14.6 Force Majeure
We shall not be liable for any failure to perform our obligations under these Terms due to circumstances beyond our reasonable control.

14.7 Export Controls
You agree to comply with all applicable export and re-export control laws and regulations.

16. Apple-Specific Terms

16.1 Acknowledgment
You acknowledge that these Terms are between you and Katarzyna Radan only, not with Apple Inc. ("Apple"), and that Apple is not responsible for the App or its content.

16.2 License
The license granted to you is limited to a non-transferable license to use the App on Apple-branded products that you own or control as permitted by the Apple App Store Terms of Service.

16.3 Maintenance and Support
Apple has no obligation to provide maintenance or support services for the App. All support inquiries should be directed to [email protected].

16.4 Warranty
Apple is not responsible for any warranty claims related to the App, whether express or implied by law.

16.5 Product Claims
Apple is not responsible for addressing any claims by you or third parties relating to the App or your use of it, including but not limited to:

• Product liability claims
• Claims that the App fails to conform to legal or regulatory requirements
• Claims arising under consumer protection or similar legislation

16.6 Intellectual Property
Apple is not responsible for any intellectual property infringement claims related to the App.

16.7 Third-Party Beneficiary
Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you.

BY USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
